Frequently Asked Questions

At Haydon Law, PSC, we understand the frustration and worry that surrounds a disabling injury or condition. Fortunately for our clients, there are government programs designed to ensure you can avoid financial peril. As with any legal situation, your best course of action is to contact an attorney to discuss the specifics of your case. For your convenience, however, our lawyers felt that a few common questions could be answered on our website.

Is There a Waiting Period that I Need to Adhere to Before Applying for Benefits?

No, there is no waiting period. In fact, you should probably apply for Social Security Disability benefits immediately after becoming disabled. If your injury, illness or disabling condition will keep you out of work for a year or more, you should file a claim. If you have questions regarding the filing of a claim, call or email our firm.

Can I Receive Workers' Compensation Benefits and Social Security Disability Benefits at The Same Time?

Yes, but it is unlikely that you will receive the maximum benefits of both. Typically, your SSD benefits will be reduced to offset the workers' compensation benefits, if your benefits exceed the allowed maximum amount

My Application for Benefits Was Denied. Am I Out Of Luck?

Even if you were denied benefits, there is an entire process built in to account for appeals. If your application was denied, it is important that you contact an attorney as soon as possible who can examine your case and provide additional guidance and representation.
